Right of Withdrawal

Unless there are any exceptions, the user may avail the right to withdraw from the contract within the term specified below (usually 14 days) for any reason and without justification. The User can find further information on the right of withdrawal in this section.

Who may avail the right of withdrawal

If one of the exception listed below does not occour, the Users who act like European Consumers may avail by law the right of withdrawal for contracts concluded online (distance contracts) within the period of time specified below for any reason and without the need for justification.

The Users who do notsatisfy such requirements may not avail the rights descripted in this section.

Exercice of the right of withdrawal

To exercise the right of withdrawal the User must send the Holder an unequivocal communication of the intention of withdraw from the contranct.

For this purpose, the User may use the withdraw module availabel in the section of the definitions of this document.  The User is however free to express the intention to withdraw from the contract in any other allowed form. In order to comply the period within the right must be exercised, the User must send the declaration of withdraw before the wothdraw term expires.

When does the withdraw term expire?

  • In case of goods purchase, the withdraw term expires after 14 days since the day in which the User or a third part – commisioned by the User and not the courier service – takes possession of the goods.
  • In case of purchase of more goods ordered together but delivered separately or in case of a single good purchase but composed of different lots or parts delivered separaely, the withdraw term expires after 14 days since the day in which the User or a third part – commisioned by the User and not the courier service – takes possession of the last of the goods, lots or parts.

Effects of the withdrawal

The Holder refunds all the payments received except, if made, the ones concerning the delivery costs to the Users who had correclty availed the right od withdrawal.

The refund occurs without undue delay and in any case within 14 days since the day in which the Holder has been informed of the decision of the User to withdraw from the contract. Except where otherwise agreed with the User, the refund is done using the same payment method used for the initial transaction. The User do not have to incur any burden as a consequence of the withdrawal, with the exception of the deliveri costs for the return of the goods.

… on contracts for the purchase of goods

The User is required to return the goods to the Holder without undue delay and in any case within 14 days since the day in which the User has communicated the intention to withdraw from the contract.

The term is complied if the delivery of the goods to the courier service happens before the expire of the 14 days period described above. The refund may be withold since the reception of the goods or since the User has provided a valid proof of the return.

The goods returned from the User towards the Holder must appear in the same form as the one when they were sent, intact and perfecly seale in the packaging. If the goods should not present such characteristis in the return phase, the Holder will be relieved from the refung obligation.

The delivery costs of the return are in charge of the User. 

Legal guarantee of conformity of the Product

According to the European legislatio, the seller guarantees the conformity of the goods sold for a minimun period of 2 years from delivery. Therefore, the seller is required to ensure that the purchased goods have the quality, functionality or characteristics primised or reasonably forseeable for at least 2 years from the time of delivery to the buyer.

If the users act as European consumers, the legal guarantee of conformity of the goods applies to the items available to the items available on this Application in agreement with the laws of the country in which they usually reside.

The national laws of that country may grant these Users broader rights.

Consumers who do not act as European COnsumers may enjoy compliance guarantee rights, under the legislation of the country in which they usually reside.
